Acceptable Use Policy

Corkboard, LLC

This Acceptable Use Policy ("Policy") applies to everyone who uses software, systems, or services provided or hosted by Corkboard, LLC, an Arizona limited liability company ("Corkboard"), including business customers and their users under the Corkboard for Business Terms and Conditions of Service, and users of the Corkboard Personal Wine Cellar (together, the "Services"). It forms part of the agreement under which you use the Services.

1. ILLEGAL OR HARMFUL CONTENT

You may not use the Services to store, display, send, or otherwise process content or activity that is unlawful or harmful, including:

  1. Fraudulent or deceptive offers, schemes, or advertising, including phishing;
  2. Content that infringes anyone's intellectual-property, privacy, or publicity rights;
  3. Content that is defamatory, obscene, abusive, threatening, or harassing, or that exploits minors in any way;
  4. Malware, viruses, or other harmful code; and
  5. Deceptive links, or content intended to manipulate search rankings or other websites.

2. ALCOHOL

Customers that sell, promote, ship, or deliver alcoholic beverages using the Services must comply with all applicable laws, including laws on licensing, minimum age, age verification at sale and at delivery, direct-to-consumer shipping, taxes, and advertising. You may not use the Services to sell or deliver alcoholic beverages to anyone under 21 years of age or to anyone you know or should know is intoxicated.

3. EMAIL AND MESSAGING

You may not use the Services to send spam. In particular:

  1. Send marketing email or text messages only to people who have agreed to receive them, and keep evidence of that consent that you can produce on request;
  2. Include a working unsubscribe method in marketing email and honor opt-out requests promptly;
  3. Do not buy, rent, or use purchased or scraped contact lists;
  4. Do not forge or disguise the sender, headers, or origin of any message; and
  5. Comply with all laws that apply to commercial email and text messages, including the CAN-SPAM Act and the Telephone Consumer Protection Act.

4. SECURITY

You may not:

  1. Access, or attempt to access, any system, account, database, or data that you are not authorized to access;
  2. Probe, scan, or test the vulnerability of the Services, or conduct any security research or audit of them, including with automated scanners, without Corkboard's prior written permission;
  3. Intercept or record data that does not belong to you; or
  4. Use social engineering, phishing, or physical means against Corkboard, its providers, or other users.

If you discover a security vulnerability, report it to Corkboard through the contact form at corkboardbusiness.com/contact and do not disclose it publicly until Corkboard has had a reasonable opportunity to fix it.

5. SYSTEM ABUSE

You may not abuse the resources of the Services, including by:

  1. Flooding the Services with traffic or requests so as to slow them down or make them unavailable;
  2. Sending large numbers of automated requests through any application programming interface without reasonable throttling. Unless Corkboard agrees otherwise in writing, sustained automated requests must not exceed one (1) request per second, without parallel requests;
  3. Crawling, scraping, or copying the Services or their content by automated means;
  4. Deliberately overloading the Services with abnormally large amounts of data or processing; or
  5. Using the Services to attack, crawl, or disrupt any third-party system.

Storage and usage above the limits stated in your Order Form, or above normal use for a business of your size, may require an upgraded plan.

6. CORKBOARD SOFTWARE

You may not copy, reverse engineer, decompile, distribute, or create derivative works of Corkboard software, or use the Services to build or assist a competing product, except as your written agreement with Corkboard expressly permits.

7. ENFORCEMENT

Corkboard may investigate any suspected violation of this Policy. Corkboard may remove content, restrict or suspend access, or terminate the Services for any violation and, where the violation threatens the security, availability, or legality of the Services, may do so without prior notice. Fees are not refunded for suspensions or terminations caused by a violation. Corkboard may report suspected unlawful activity to the appropriate authorities and cooperate with them.

8. REPORTING

9. CHANGES

Corkboard may update this Policy. Each version carries a version number and effective date, and prior versions remain available at corkboardbusiness.com/legal. For business customers, a new version applies as described in the Corkboard for Business Terms and Conditions of Service.
