This Privacy Policy explains how Corkboard, LLC, an Arizona limited liability company ("Corkboard," "we," "us," or "our") collects, uses, shares, and protects personal information in connection with corkboardbusiness.com and the other websites we operate (the "Sites") and the Corkboard for Business software and services we provide to wine clubs, wineries, and similar businesses (the "Business Services").
The Corkboard Personal Wine Cellar app has its own Privacy Policy, published with the app, which explains what the app collects and what it shares with your wine club.
1. OUR ROLE
For the Sites and our business relationships, Corkboard decides how personal information is used and is responsible for it under this Privacy Policy. This covers visitors to the Sites, people who contact us, and the people we work with at our business customers.
For the Business Services, our business customers decide how information about their own members and customers is used. Corkboard acts as their service provider: we process that information on their behalf, under our agreement with them, and only to provide, support, and secure the Business Services. If you are a member or customer of a wine club that uses Corkboard, the club's privacy policy applies to the club's use of your information, and questions about it should be directed to the club.
2. INFORMATION WE COLLECT
Information you provide:
- Messages you send us through a contact form, including your name, email address, phone number, company or club name, and the content of your message;
- Business contact and account information for our customers and prospective customers, such as the names, job titles, email addresses, and phone numbers of the people we work with, and billing details; and
- Login information for people we give access to a Corkboard system, such as a business customer's staff or a prospective customer evaluating Corkboard.
Information collected automatically:
- Device and usage information, such as your IP address, browser type, device type, pages viewed, and the dates and times of visits and logins;
- Approximate location (city, region, and country) derived from your IP address. We do not collect precise location from your device;
- For logins to a Corkboard system, a record of activity, such as the user, network address, dates and times, pages viewed, and actions taken, which we keep for security and to enforce our agreements; and
- Cookies and similar technologies used for security, to keep you signed in, and to remember your preferences.
3. HOW WE USE INFORMATION
We use the information described in Section 2 to:
- Operate and maintain the Sites and the Business Services;
- Respond to inquiries, arrange demonstrations, and provide support;
- Manage our relationships with customers and prospective customers, including contracts and billing;
- Send business communications about Corkboard, from which you can unsubscribe at any time;
- Protect the security of our systems and users, including detecting and preventing fraud, abuse, scraping, and unauthorized access;
- Understand how the Sites are used so we can improve them; and
- Comply with law and enforce our terms and agreements.
4. INFORMATION WE PROCESS FOR WINE CLUBS
When a wine club uses the Business Services, the club's information about its members and customers, such as names, contact details, memberships, orders, and shipments, is stored in the club's own system, which Corkboard hosts and supports. This information belongs to the club.
Corkboard uses it only to provide, support, and secure the Business Services. In running our business we use high-level information only, such as the number of members and active accounts, usage, and system health. Corkboard personnel access individual records only to provide support the club requests, to keep the system secure and working, or where the law requires.
We do not sell this information, use it for advertising, or use it to market Corkboard to a club's members.
5. ARTIFICIAL-INTELLIGENCE FEATURES
Some features of the Business Services, such as reading a wine label from a photo, send the photo or text submitted to a third-party artificial-intelligence service to produce the result. We use these services through their business application programming interfaces, only to provide the feature requested. The services we use are named in our Subprocessor List.
6. HOW WE SHARE INFORMATION
We do not sell personal information, and we do not share it for targeted advertising. We share personal information only as follows:
- With service providers that operate our services on our behalf under confidentiality obligations, such as hosting and data-storage providers, network and security providers, email providers, and artificial-intelligence services. A current list is published at corkboardbusiness.com/legal;
- With a business customer, information that belongs to that customer, as part of providing the Business Services to it;
- For legal reasons, if required by law or legal process, or to protect the rights, safety, and property of Corkboard, our customers, or others; and
- In a business transfer, such as a merger, acquisition, or sale of assets, subject to this Privacy Policy.
7. YOUR CHOICES
- You can unsubscribe from our business emails using the link in any email or through our contact form;
- You can request access to, correction of, or deletion of your personal information by contacting us as described below. If your information is held in a wine club's system, we will refer your request to the club, or help the club respond to it; and
- You can block or delete cookies through your browser settings; some features may not work without them.
8. DATA RETENTION
We keep personal information for as long as needed for the purposes described in this Privacy Policy, including for the length of our relationship with a business customer and as needed for legal, tax, and accounting purposes. Information we process for a wine club is kept or deleted according to our agreement with the club. Copies may remain in backups for a limited period until they are overwritten.
9. SECURITY
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption of data in transit, hashed passwords, a separate database for each business customer, and access logging. No system is completely secure, and we cannot guarantee absolute security.
10. CHILDREN
The Sites and the Business Services are intended for adults and businesses and are not directed to children. We do not knowingly collect personal information from children under 13. If you believe we have, please contact us and we will delete it.
11. CALIFORNIA AND OTHER U.S. STATES
If you are a California resident, you may have the right, subject to applicable law, to request that we disclose the categories and specific pieces of personal information we have collected about you; to request deletion or correction of your personal information; and to not be discriminated against for exercising these rights. We do not sell or share personal information as those terms are defined under California law, and we do not use sensitive personal information for purposes that would require offering a right to limit. The categories of personal information we collect are described in Section 2, the purposes in Section 3, and the categories of recipients in Section 6.
Residents of other states may have similar rights under their state's law. You may submit a request, or have an authorized agent submit one for you, using the contact information below. We will verify your request before responding. Where we hold information as a wine club's service provider, we will refer your request to the club, or help the club respond to it.
12. WHERE WE PROCESS INFORMATION
Corkboard is based in the United States, and we store and process personal information in the United States.
13. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy. Each version carries a version number and effective date, and a new version replaces the prior one from its effective date. We will post the updated policy on the Sites. Prior versions remain available at corkboardbusiness.com/legal.
